Question:

I was not discharged from a previous bankruptcy and was given a few credit cards... can not pay them back. If I was already bankrupt when the credit cards were given to me, and now I can not pay them back, what are my options? Is it the credit card company's fault for giving me credit cards while I was bankrupt?

Answer:

Have you now been discharged from your bankruptcy in Calgary? If so, you may wish to contact our office or speak to a Trustee in your area of residence to discuss your current options, which could include making an informal or formal proposal to your creditors, orderly payment of debt, or a second bankruptcy. Please note that if you make a second assignment in bankruptcy, it will be more difficult to obtain your discharge than in a first time bankruptcy. If you are not yet discharged from your first bankruptcy, the first thing you may wish to do is contact your trustee to determine what you need to do to obtain your discharge. I assume you are aware, that you must inform the credit provider that you are an undischarged bankrupt, when obtaining credit of $500 or more.
